VuSpaces Photographer Terms
Terms for photographers applying to and working through the VuSpaces photographer network.
1. About these terms
These terms apply when you apply to join, are accepted into, or carry out photography assignments through the VuSpaces photographer network.
By accepting these terms you confirm that the information you provide to VuSpaces is accurate and that you will comply with these terms when carrying out any VuSpaces assignment.
2. Independent service provider
Photographers are independent service providers. Nothing in these terms creates an employment relationship, worker relationship, partnership, agency or joint venture between you and VuSpaces.
You are responsible for your own tax, National Insurance, VAT and other legal or financial obligations arising from fees you receive for photography services.
3. Photographer applications and approval
Submitting an application does not guarantee acceptance into the photographer network or the offer of any assignment. VuSpaces may review your experience, equipment, portfolio, location, availability and other information relevant to assignments.
VuSpaces may approve, decline, suspend or remove a photographer account where reasonably necessary to protect venues, customers, the platform or the quality of the service.
4. Assignments
Each photography assignment may specify the venue, location, date, scope of work, expected deliverables, fee and any other relevant requirements.
You may accept or decline an offered assignment. Once an assignment is accepted, you should attend as agreed and tell VuSpaces promptly if you become unable to complete it.
5. Photography fees and expenses
Photography fees are agreed separately for each venue assignment. Your preferred shoot or day rate submitted to VuSpaces is an indication only and does not create an entitlement to work at that rate.
Unless agreed otherwise in writing for a particular assignment, you are responsible for your own equipment, transport, travel costs and other expenses.
6. Professional standards
You agree to act professionally when attending a venue and to follow reasonable instructions relating to access, safety, photography and the required deliverables.
You should use suitable equipment and provide technically usable material of a standard appropriate for a commercial virtual tour. Where a VuSpaces assignment requires 360° imagery, the expected deliverable is normally the original full-resolution equirectangular 360° JPG unless otherwise agreed.
7. Insurance, equipment and safety
Where you state that you hold public liability insurance, that information must be accurate. VuSpaces may ask you for evidence of current insurance before an assignment.
You are responsible for using your equipment safely and for complying with reasonable venue health and safety rules.
8. Venue information and confidentiality
Venue names, addresses, contact names, email addresses, telephone numbers, access information, booking details and other information provided to you through VuSpaces must be treated as confidential where it is not already public.
You may use venue contact information only where reasonably necessary to arrange or complete the relevant assignment. You must not sell, disclose, harvest or use venue contact information for unrelated marketing or solicitation.
9. Venue introductions and circumvention
Where VuSpaces introduces you to a venue, you must not use that introduction deliberately to bypass VuSpaces in order to offer a competing virtual-tour hosting service or to move the introduced VuSpaces work outside the platform.
This does not prevent you from carrying out unrelated photography work for a venue where that work is genuinely separate from the VuSpaces service.
10. Ownership of assignment content
For photographs, 360° imagery and other visual material created specifically for a VuSpaces assignment, you assign to VuSpaces, to the extent permitted by law, all copyright and other intellectual property rights in that assignment content from the time those rights arise.
You also grant VuSpaces the right to edit, crop, process, stitch, brand, reproduce, publish, host, distribute, archive, adapt and sublicense that content for the operation, promotion and delivery of VuSpaces and the relevant venue's services.
You must not knowingly provide material that infringes the intellectual property rights of another person.
11. Venue use of content
VuSpaces may make assignment content and the resulting virtual tour available to the relevant venue for use in accordance with the venue's VuSpaces service or subscription.
12. People and personal information in imagery
Where reasonably practicable, you should avoid capturing identifiable members of the public, confidential documents, payment information or other unnecessary personal data in assignment imagery.
If people or sensitive information are captured unintentionally, you should tell VuSpaces where this may require editing, blurring or removal.
13. Account security
You are responsible for keeping your photographer account password secure and for activity carried out using your account. You should notify VuSpaces promptly if you believe your account has been accessed without permission.
14. Suspension or removal
VuSpaces may suspend or remove a photographer from the network for serious or repeated quality problems, non-attendance, misuse of venue information, fraudulent or misleading information, unsafe conduct, infringement of third-party rights or other material breach of these terms.
15. Changes to these terms
VuSpaces may update these terms from time to time. Material changes will apply from the date the updated terms are made available, subject to any notice required by law.
16. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply to you.
VuSpaces Photographer Privacy Policy
How VuSpaces uses personal information relating to photographer applicants and network members.
1. About this policy
This privacy policy explains how VuSpaces collects, uses, stores and shares personal information about photographers who apply to or participate in the VuSpaces photographer network.
VuSpaces acts as the controller of the personal information described in this policy where it determines why and how that information is used.
2. Information we may collect
Depending on how you use the photographer service, we may collect:
- your name and company or trading name;
- email address and telephone number;
- address, town or city, postcode or ZIP code and country;
- approximate working-location coordinates and travel radius;
- photography experience and equipment information;
- portfolio or website links;
- your preferred photography or day rate;
- whether you have transport, public liability insurance or VAT registration;
- application status and photographer-account information;
- assignment history and communications relating to assignments;
- login, security and technical information such as IP address, browser or device information where recorded by our systems;
- information you send to us when requesting support or contacting VuSpaces.
3. Why we use your information
We may use your information to:
- review and administer photographer applications;
- create and manage photographer accounts;
- identify photographers close to potential venue assignments;
- offer, arrange and administer photography assignments;
- communicate with you and with relevant venue contacts;
- maintain service quality and photographer records;
- protect the security and integrity of VuSpaces;
- prevent fraud, misuse or unauthorised access;
- meet legal, accounting, tax or regulatory obligations where applicable.
4. Working-location information
Your photographer signup may store latitude and longitude coordinates representing your approximate working location. VuSpaces uses this information to calculate your distance from potential venue assignments and to help match work to nearby photographers.
Your working-location coordinates are not intended to be displayed publicly.
5. Legal bases
Depending on the circumstances, VuSpaces may process your information because it is necessary to take steps at your request before entering into an arrangement with you, to perform an assignment or other agreement, to comply with a legal obligation, or because VuSpaces has a legitimate interest in operating, securing and improving the photographer network.
Where consent is the appropriate legal basis, you may withdraw that consent at any time. Withdrawal does not affect processing that was lawful before consent was withdrawn.
6. Sharing information with venues
Where necessary to arrange or complete an assignment, VuSpaces may share relevant photographer information with the venue, such as your name, contact details and information needed to coordinate the shoot.
VuSpaces may likewise provide you with relevant venue contact information for the purpose of completing that assignment. That venue information must only be used for the relevant assignment and in accordance with the Photographer Terms.
7. Service providers
VuSpaces may use hosting, email, database, security, analytics, payment, mapping or other technical service providers to operate the platform. Those providers may process personal information on VuSpaces' behalf where this is necessary to provide their services.
8. International transfers
Some service providers may process information outside the United Kingdom. Where required, VuSpaces will use appropriate safeguards for international transfers of personal data.
9. How long information is kept
VuSpaces will keep photographer information only for as long as reasonably necessary for the purposes described in this policy, including maintaining the photographer network, administering assignments, resolving disputes, preventing misuse and meeting legal or record-keeping obligations.
Unsuccessful or inactive applications may be deleted or anonymised when they are no longer reasonably required.
10. Security
VuSpaces uses reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse or disclosure. No internet service can guarantee absolute security.
11. Your data-protection rights
Depending on the law that applies, you may have rights to request access to your personal information, ask for inaccurate information to be corrected, request deletion or restriction, object to certain processing, and receive certain information in a portable format.
You may also have the right to complain to the UK Information Commissioner's Office or another relevant supervisory authority.
12. Updating your information
Please keep your photographer profile and contact information accurate. You can also contact VuSpaces using the contact details published on vuspaces.com if you need personal information corrected or want to make a data-protection request.
13. Changes to this policy
VuSpaces may update this privacy policy where the photographer service, legal requirements or the way personal information is handled changes.
